Sugarbar Sweets operates under a valid California Cottage Food Operation (CFO) permit issued by the Orange County Health Care Agency.
All baked goods are produced in a permitted home kitchen in compliance with California Health and Safety Code §114365 et seq.
By placing an order through our website or by direct message on Instagram (@sugarbarsweets), you agree to the following policies.
1. Orders and Payments

Orders may be placed through our website or by direct message on Instagram (@sugarbarsweets).

Full payment is required at the time of ordering. Orders are not confirmed or scheduled for production until payment has been received in full.

By submitting payment, you acknowledge that you have reviewed and approved all order details, including product type, design, flavor, and pickup time.

Once payment is processed, all orders are considered final and cannot be canceled, modified, or refunded, except as provided under California law.

For orders placed via Instagram DM, payment instructions and confirmation will be communicated through the same platform.
2. Pickup Policy
Pickup Information:
All custom cake orders are pickup only in Irvine, CA (ZIP 92612). 24 hours prior to pickup detailed pickup instructions will be sent via text message to the phone number provided at checkout.

Pickup times are confirmed once your order is accepted. Customers are expected to arrive promptly to ensure product freshness and food safety.

A $30 late fee may apply if pickup occurs more than one hour after the scheduled time, provided this charge reasonably reflects administrative or scheduling costs.

Orders not picked up on the scheduled date will be considered forfeited and will not be refunded or replaced.

Sugarbar Sweets is not responsible for products once they have been released to the customer or a designated recipient.
3. All Sales Are Final
All orders are non-refundable and non-exchangeable, as products are custom-made and perishable.
Refunds will only be considered in the event of a verified error by Sugarbar Sweets, such as receiving the wrong product.
To request a review, please contact us within 24 hours of pickup and include clear photos of the issue.
Approved refunds, if warranted, will be processed to the original payment method within 5–10 business days.
Refunds will not be issued for:

Variations in color, size, or design

Subjective taste or aesthetic preferences
These conditions comply with California Civil Code §1671(b), which permits reasonable liquidated damages or fees when disclosed and agreed upon before purchase.
4. Food Safety and Allergen Disclosure
All products are made in a home kitchen permitted under California Health & Safety Code §114365.
This kitchen handles milk, eggs, wheat (gluten), soy, peanuts, and tree nuts.
While we take precautions to minimize cross-contact, we cannot guarantee that any product is allergen-free.
Customers must disclose allergies prior to placing an order.
By purchasing and consuming our products, you acknowledge and accept the inherent risk of allergen exposure.
5. Design Disclaimer
Customers may submit inspiration or reference images, including AI-generated or online photos, for design direction.
Sugarbar Sweets welcomes these references but does not guarantee exact replication.

Each design reflects our creative interpretation, materials available, and handcrafted process.

Variations in color, texture, and detail are normal due to the nature of custom, handmade goods.
By submitting reference images, you authorize Sugarbar Sweets to interpret your concept within our established style and capabilities.
6. Limitation of Liability
To the maximum extent permitted by law, Sugarbar Sweets is not liable for indirect, incidental, or consequential damages arising from:

Customer handling or storage of products

Allergic reactions or design variations
Our total liability for any claim shall not exceed the original purchase price of the item in question.
Nothing in this section limits rights that cannot be waived under California Civil Code §1668.
7. Force Majeure
Sugarbar Sweets is not responsible for delays or cancellations resulting from events beyond our reasonable control, including but not limited to illness, power outages, natural disasters, or ingredient shortages.
In such cases, we will make reasonable efforts to reschedule or issue a refund at our discretion, consistent with California Commercial Code §2615.
8. Intellectual Property
All images, designs, text, and branding on the Sugarbar Sweets website and social media accounts are the property of Sugarbar Sweets.
They may not be copied, reproduced, or distributed without prior written consent.
This complies with California Civil Code §980(a) (ownership of original works).
9. Governing Law
These policies and any disputes arising under them are governed by the laws of the State of California.
Any legal proceedings shall take place in the appropriate courts of Orange County, California, in accordance with California Code of Civil Procedure §395(a).
10. Amendments
Sugarbar Sweets reserves the right to update or revise these policies at any time.
Changes will take effect upon posting with a revised effective date.
Your continued use of our website or placement of orders through Instagram DM constitutes acceptance of the updated policies.
